1. Acceptance of Terms

By accessing or using the EquityNgin platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

EquityNgin provides real estate analytics tools for the Dubai property market, including yield analysis, transaction data, developer scoring, and portfolio tracking. The Service is provided on a subscription basis.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

Each account is licensed to a single named user. You may not share your login credentials with any other person, including colleagues within the same organisation. If additional users require access, the account administrator must purchase additional seats under the appropriate subscription plan.

4. Subscription and Billing

• Trial accounts have limited access. Paid subscriptions grant access to all available analytics tools. Pricing is displayed on the billing page.
• Payments are processed securely through Stripe. We do not store your card details.
• Subscriptions renew automatically. You may cancel at any time through your billing settings.
• Refunds are handled on a case-by-case basis within 14 days of payment.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to scrape, copy, or redistribute data from the platform
• Share your account credentials with any third party, including colleagues, clients, or family members
• Allow multiple individuals to access the Service using a single account
• Reverse-engineer any part of the platform
• Use automated tools to access the Service beyond normal use
• Circumvent or attempt to bypass any technical measures designed to enforce these Terms, including session management controls

6. Account Sharing Policy & Enforcement

EquityNgin enforces a single active session per user policy. Only one device may be signed in to an account at any time. Signing in on a new device will automatically terminate any existing session.

We actively monitor login patterns, including IP addresses, device information, and session activity, to detect potential credential sharing. If our systems detect activity consistent with account sharing, we will take the following graduated enforcement actions:

• First occurrence: An email warning will be sent to the account holder notifying them of the suspected violation.
• Second occurrence: A formal written warning will be issued, and the account may be temporarily restricted.
• Continued violations: The account will be suspended without refund. Repeated or egregious violations may result in permanent termination of the account and forfeiture of any remaining subscription period.

If you believe your account has been compromised or used without your authorisation, contact us immediately at support@equityngin.com and change your password.

7. Data and Analytics Disclaimer

The analytics, scores, and data presented through EquityNgin are for informational purposes only. They do not constitute financial, investment, or legal advice. Market data is sourced from publicly available records including the Dubai Land Department and third-party listing platforms. We make reasonable efforts to ensure accuracy but do not guarantee it.

You should conduct your own due diligence and consult qualified professionals before making any property investment decisions.

8. Intellectual Property

All content, design, algorithms, and data compilations on EquityNgin are our intellectual property. Your subscription grants you a personal, non-transferable license to use the Service. You may not reproduce, distribute, or create derivative works from our content without written permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, EquityNgin and its operators shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding any claim.

11. Modifications

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or in-app notification.

12. Termination & Suspension

We reserve the right to suspend or terminate your account if you violate these Terms, including but not limited to the account sharing policy described in Section 6. Upon suspension or termination, your right to use the Service ceases immediately. No refund will be issued for accounts terminated due to Terms violations.

13. Governing Law

These Terms are governed by the laws of the Emirate of Dubai and the United Arab Emirates. Any disputes shall be resolved through the courts of Dubai.
